By accessing our website or signing a service contract with House Upgrade Zone LLC ("Company", "we", "us"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or engage our services.
2. Definitions
- "Client" means any individual or entity that engages House Upgrade Zone for services.
- "Project" means the specific renovation work described in a signed contract.
- "Contract" means the signed agreement governing scope, price, timeline, and warranty.
- "Website" means houseupgradezone.com and all associated subdomains.
3. Use of Our Website
You agree to use our website only for lawful purposes. You may not:
- Use the website in any way that violates federal, state, or local laws.
- Attempt to gain unauthorized access to any part of the website or its servers.
- Use automated systems (bots, scrapers) without written permission.
- Transmit viruses, malware, or harmful code.
- Impersonate any person or misrepresent your affiliation.
4. Service Engagement Process
4.1 Consultation & Proposal
Initial consultations are free and non-binding. A detailed proposal is provided within 7 business days of a completed site visit. Proposals are valid for 30 days.
4.2 Contract Signing
Projects begin only after a signed contract and receipt of the initial deposit (typically 10% of the total project cost).
4.3 Cooling-Off Period
All contracts include a 14-day cooling-off period. You may cancel within 14 days of signing with a full refund of your deposit, minus any third-party costs already incurred on your behalf (e.g., architectural drawings already paid for).
5. Pricing & Payment Terms
- All prices are quoted in U.S. dollars and are fixed as of the contract signing date.
- Payments are made according to milestones outlined in the contract (typically: deposit, demolition, framing, finishes, final walkthrough).
- Late payments incur a 1.5% monthly finance charge.
- We accept check, ACH transfer, wire transfer, and major credit cards (credit card payments incur a 3% processing fee).
- Change orders requested by the client require written approval and are billed at cost plus 15%.
6. Project Timelines
Estimated timelines are provided in good faith based on project scope and current crew availability. We commit to on-time delivery subject to the following:
- Weather delays, supply-chain disruptions, or force majeure events.
- Client-requested change orders that extend the scope.
- Client-caused delays (e.g., late material selections, late payments).
- Unforeseen structural conditions discovered during demolition.
If House Upgrade Zone is responsible for a delay (outside the above exceptions), we provide a credit of $250/day against the final invoice after 7 days of delay.
7. Warranties
- Refresh tier: 5-year workmanship warranty.
- Transform tier: 10-year workmanship and structural warranty.
- Elevate tier: Lifetime workmanship warranty for original homeowner.
Manufacturer warranties on materials and fixtures are passed through to the client. Warranty claims must be made in writing within 30 days of discovering the issue. Warranty does not cover damage from misuse, natural disasters, or unauthorized modifications.
8. Client Responsibilities
To ensure smooth project delivery, the client agrees to:
- Provide timely selections for materials, finishes, and fixtures.
- Maintain clear access to the work area during scheduled hours.
- Secure pets and children away from active work zones.
- Maintain adequate homeowner's insurance throughout the project.
- Obtain HOA approvals when applicable.
9. Permits & Inspections
House Upgrade Zone will obtain all required building permits and schedule inspections on your behalf. Permit fees are included in your contract. You agree to cooperate with inspectors and provide access as needed.
10. Intellectual Property
All design concepts, drawings, and renderings created by House Upgrade Zone remain our intellectual property until the project is complete and paid in full, at which point ownership transfers to the client. You may not use our designs for competing bids without written permission.
11. Limitation of Liability
To the maximum extent permitted by law, House Upgrade Zone's total liability for any claim arising from our services shall not exceed the total amount paid by the client under the relevant contract. We are not liable for:
- Indirect, incidental, or consequential damages.
- Loss of use of the property during renovation.
- Costs of temporary relocation unless specifically agreed in the contract.
12. Cancellation & Termination
Either party may terminate the contract with 14 days written notice. Upon termination, the client is responsible for:
- Payment for all work completed to date.
- Non-cancellable material orders already placed.
- A termination fee equal to 5% of the remaining contract value.
13. Dispute Resolution
Any dispute arising from these Terms or our services shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute will be submitted to binding arbitration in Kentucky under the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with your signed service contract, constitute the entire agreement between you and House Upgrade Zone. They supersede all prior discussions, proposals, or representations.
17. Changes to Terms
We reserve the right to update these Terms at any time. Changes take effect immediately upon posting. Your continued use of our website or services after changes constitutes acceptance.
